General Limitations

The laws of England and Wales govern all terms of trading. All parties are subject to the exclusive jurisdiction of the English courts. Without prejudice to statutory rights given to purchasers of products, the information and materials contained within this website, including without limitation, graphics, text and links, are provided to the best of our knowledge and ability and we cannot accept liability as to the truth, accuracy, or completeness of any product or service portrayed within. All products and services are subject to availability, which may be withdrawn from sale to the public at any time. In such cases customers will be offered an alternative or the option of a full refund. Prices are subject to change without notice at any time before formal acceptance. Gateway Services has not provided any testing on products for safety, reliability, compliance, quality or function. Use of this website is at your own risk. No assurance is given as to it being free of errors; viruses, worms or other problems and Gateway Services shall not be held liable for any damage that may be suffered as a result of such contamination or features. Goods remain the property of Gateway Services until full payment has been received and processed through our bank.
 
Confirmation of Orders & Payment Details
Orders placed with Gateway Services will be considered valid when placing the order by phone or through our online secure server. We do however reserve the right to cancel any order by phone email or letter and arrange for a full refund within one working day (Monday -Friday) in the rare situation of not being able to fulfil the order for whatever reason. Every effort of course is made to fulfil and deliver customer orders. Products are delivered directly to our customers from the manufacturers. We remain dependant upon the manufacturers to deliver the correct products direct to our customers. Accurate estimations based on current conditions are given on this website for each product. Occasionally a Product may take longer to be delivered. In this instance the customer is given the opportunity to wait or ask for refund. Payment may be made by cheque payable to Gateway Services. In these case the delivery of your goods may be delayed until our bank has cleared the payment.

Failure to Dispatch
Without prejudice to the statutory rights of customers under English law, Gateway Services accepts no responsibility for failure of third-party manufacturers or their transportation agents to dispatch ordered goods directly to our customers. Should such failure occur, or should Gateway Services be unable to fulfil an order for any other reason, Gateway Services undertake to inform the customer within 21 days of the order's acceptance. In such cases Gateway Services will, as appropriate, provide either an immediate and full refund, or will not process the payment. The order will then be declared formally cancelled. It is stressed that Gateway Services can only take responsibility for delivery of stock to customers once Products have been delivered from the manufacturer(s). Liability for late delivery is strictly limited to the total value of the goods concerned and cannot include any other related claims however caused.

Returns
We sell top quality Products and as such do not expect problems with any of our products. At least one full year’s parts and labour guarantee however cover all goods. It is essential that every effort be made to identify any external marks or damage that could possibly have occurred due to transportation. It is a condition of sale that such damage must be reported to us within three working days (Monday to Friday) giving us the opportunity to provide a satisfactory solution. We feel that this three-day limit is a reasonable time for all our customers. If a fault is discovered after 28 days of receipt then we will arrange a service call or arrange a collection as is thought appropriate. It is very important to note that it is always the customer’s responsibility to ensure that adequate packaging is used, as Gateway Services will not accept responsibility for damage caused by transportation back to us. Products returned to us in a damaged condition (not caused by transportation) will either be returned at the customer's expense or sold at a reduced price. If this latter option is agreed then it follows that any refund must be withheld until the sale to the third party is made and the correct sum can then be calculated. We do require written, faxed or emailed confirmation that there is a problem with the Product. Reliance on a telephone conversation is not sufficient. Returns of perfect goods may be returned within 14 days of receiving them at the customer’s own expense for a full refund. In such cases it is conditional upon them being returned in their original packaging and must be unused.
Please ensure that you are certain that the product ordered is exactly what is required. Details of each model are detailed on our site but cannot cover every detail. Please note that a 20% administration charge is payable on all items ordered but later cancelled, refused or returned by the customer, to also include any delivery costs incurred by Gateway Services for the return of that product. If the order can be cancelled before being entered onto our system then a small administration charge in the region of £15-20 will be made to cover our costs. When the item(s) has been paid for by a credit card then an additional 1.5% may be charged for each transaction processed.

Checking Your Goods
Deliveries are undertaken by the manufacturer's own service to our customers. It is a delivery service that does not include connection or installation.
There are no restrictions on where we deliver but we ask our customers to make easy access available to the drivers. Failure to inform us about likely problems may result in the item being left outside the delivery address at your risk, or returned to a warehouse for redelivery if the driver is experiencing great difficulty. In this instance we will need to charge a redelivery fee of approximately £45 to cover our costs.

IT IS VERY IMPORTANT that you check the Product when delivered to you. We must be informed of any damage preferably on the day of delivery but at the very outside within three working days to allow us time to investigate and resolve the matter with the manufacturers or couriers. We will give every effort to resolve problems of this kind discovered after three working days of receipt.

IT IS ABSOLUTELY IMPORTANT TO ARRANGE FOR SOMEONE TO BE PRESENT AT THE DELIVERY ADDRESS TO ACCEPT THE PRODUCT (S). If the delivery is unable to be completed through no fault of our own as a result of the customer or their representative being unavailable to accept the consignment on the date agreed, a charge will be made usually in the region of £45-£55 for each prearranged but failed delivery to partially offset our transportation costs. This sum must be settled before the delivery can be rearranged.

Our Privacy Policy
When you place an order or use a form on our website, we may need to know your name, contactable telephone number, postal and email address and we may also need your credit card details if using our secure server. By submitting this detail you consent to the use of this information in order to process your order or to action your request. The relevant information is then used by us and our agents to provide you with the service you have requested. The information you provide is not made available to any other people or organisations, and is kept secure at all times.

Consumer Protection
For your protection, this website is intended to be fully compliant with the consumer protection (distance selling) regulations 2000. Customers can view and read about the features and benefits of items on sale from viewing the appropriate pages of this website. Please inform us if more information can be added. It is also confirmed that our customers will receive written confirmation of their purchase usually in the post within a few days of the sale. Also in line with the 2000 regulation customers have the right to cancel within a period of seven working days (Monday-Saturday) from the day of delivery. Written, faxed or emailed correspondence cancelling the sale must be received. Reliance on a telephone conversation is not sufficient. Please refer to your local trading standards office for full details of the regulations but briefly, items can be returned to us under this legislation if the customer pays for the post and packing. Confirmation of the Product being in perfect condition by the courier company selected is required. Products returned to us in a damaged condition (not caused by transportation) will either be returned at the customer's expense or sold through one of our stores at a reduced price. If this latter option is agreed then it follows that any refund must be withheld until the sale to the third party is made and the correct sum can then be calculated. It is also mentioned that customers should retain the original packaging for the cooling-off period, to enable the item to be returned to us in saleable condition. These regulations only apply to unused goods.
Electronic Commerce (EC Directive) Regulations 2002
Gateway Services fully support all government legislation and wish to also include this further directive in our website which asks all website dealers to ensure certain information is included for all customers. i.e.:
1. Our trading name is Gateway Services. Please use our email address info@gatewayservices.org.uk to ask any relevant question.
2. Our terms and conditions are concise and fair. They can be found in full detail under their own heading above.
3. A reasonable description is to be found for each product sold along with full details of the price and any delivery charges payable. All items are shown inclusive of all VAT charges. Please advise us of any page that is lacking in detail so it can be amended.
4. Prices are current as shown on the day of sale although it is stressed that as our sales margins are very small making us a usually less expensive than most of our competitors, we do need to respond quickly to manufacturers' price alterations as well as other factors. This does mean our prices can vary upwards as well as downwards within any given month. It is guaranteed however that the price offered at the time would be that what is asked even if the price is later altered before delivery.
5. The contract is considered binding between our customers and ourselves when we have confirmed the sale either by email, the receipt by letter or verbal communication.
6. Information about the availability, delivery and despatch of the goods is the responsibility of our sales staff who is very keen to ensure that our customers receive their goods as quickly as possible.
7. It is occasionally regrettable that the manufacturers may experience difficulties in producing or delivering Products to customers within a reasonable period of time. Please do not hesitate to email or phone us to establish the current situation. If we are unable to fulfil the contract for this reason then we have no problem in refunding monies paid or offering an alternative. We are looking to you for repeat business so are eager to consider good customer relations as a priority.

9. Gateway Services is a UK company and is therefore subject to the applicable law. Customers are reminded therefore that they are entering into a legally binding contract when purchasing goods from this website.
10. This website has been written and analysed in depth by ourselves but like all human input is open to unintentional error. We will rectify any problem arising from this website as quickly and as reasonably as possible.
